Statement of Responsibility

By using Northern Host's services, I agree to the following conditions:

1. I am responsible for all equipment fees and payment for service(s).

2. If any equipment was involved in Northern Host's services, I am responsible for returning the equipment upon termination of account unless I own the equipment. This includes the device(s), any cords, and any installation CD and/or software in proper working order in the original case any and all equipment came in.

3. I understand accounts remain open until the calendar month the device and the entire contents of the original case, including the case, is received by Northern Host at the Mio, MI address (225 South Morenci Avenue, P.O. Box 517, Mio, MI 48647). If it is impossible to return the device(s) and the contents of the case, I agree to pay a $300.00 termination fee and no longer be held responsible for the account. (It is not necessary to return equipment if you have purchased the equipment from Northern Host.)

4. I understand that Northern Host has a zero tolerance policy on past due accounts. If my bill has not been received by the billing date, I agree to authorize Northern Host to automatically deduct payment from my credit/debit card on file.

5. I understand that it is my responsibility to provide Northern Host a current email address that I check regularly and to notify Northern Host of any changes to my email address and account information.

Use of any of Northern Host's service for other than its proscribed purpose is prohibited. Charges plus penalties will immediately be applied to the users system of payment.

Disclaimer

Agreement - Northern Host is an internet service company. This agreement sets forth the Account Terms and Conditions that apply to the subscriber for use of Northern Host. The subscriber is deemed to have agreed to comply with all terms by use of Northern Host's services.

Billing Period - All services provided by Northern Host will be billed in advance for the forthcoming month. A Credit/Debit card is required on file for any service.

Returned Checks - A returned check charge of $30.00 will be incurred for all returned checks.

Payment - The subscriber is responsible for choice of service and is bound to remit payment. It is understood that all billings are due on the date of the invoice, and it is agreed that all charges not paid by the due date on the invoice are subject to an automatic withdraw from the credit/debit card on file. Northern Host has a zero tolerance for past due accounts. In the event that any litigation is instituted for the collection of the above account or debt incurred, it is agreed by entering into this agreement that all but not limited to collection and court costs will be paid, including reasonable attorney’s fees / collection fees. By accepting the terms and conditions above certifies that the foregoing is a transaction, and waives its’ rights to a notice and hearing for a pre-judgment remedy.

Billing Disputes - All billing disputes, with Northern Host, must be received at our business office in writing, and the obligation to pay for service will continue until such notice is received. Termination of your service does not constitute relief from amounts incurred prior to termination. Agreements not on a monthly basis (annual, semi-annual, etc...) can be cancelled in writing, by email, or by phone, but the subscriber will be obligated to pay any and all monthly fees until termination of the agreement is finalized.

Equipment Issues - The client is responsible to alert our technical support team in a timely manner in the event there are issues with the equipment provided. Until such contact takes place, Northern Host cannot be held responsible for service or product concerns. It is important the client document date, time and the technician spoken with, client should escalate unsatisfactory results to support@northernhost.net

Cancellation Policy - Cancellation requests must be received 10 days before the due date on the invoice of the month in order to be cancelled for the next month. Any cancellation requests received on or after the cancellation date will be billed automatically for the next month with the credit/debit card on file. There is no refund. All cancellations must be made via e-mail or the postal service so we can have exact record of the date and specific request of the customer.

Customers who have leased equipment - The account will be considered closed during the calendar month the equipment is returned in proper working order in its original case with the original contents at our Mio, MI address. Monthly service payment is required in entirety for the calendar month the device is received. Failure to return the device upon cancellation will result in a $300.00 termination fee.

Legality of Content - The subscriber agrees to use Northern Host's services for lawful purposes only. The subscriber will not post or transmit any material, through Northern Host, which violates or infringes upon the rights of other users. This includes, but is not limited to: threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights or which is considered objectionable, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to outside computer systems are expressly prohibited. Users agree to abide by any and all rules of the network they access through Northern Host. The subscriber agrees to defend and hold harmless Northern Host, its directors, officers, employees, agents or affiliates for all damages and claims that might arise from the subscribers use or misuse of the service, which damages or otherwise harms either the subscriber, Northern Host or a third party.

Responsibilities - Northern Host makes no warranties, expressed or implied, regarding services provided. Northern Host is not responsible for any damages suffered from the use of our services, including but not limited to, loss of data, service interruptions and/or delays, or third party litigation.

Content Screening - Northern Host cannot and does not control the content of information available over the Internet. For this reason, the subscriber certifies that he/she is at least 18 years of age or, if the subscriber is a parent or guardian, he/she assumes all responsibility for supervising the on-line activities of the underage user. Any information garnered through Northern Host is done so at your own risk.

Unauthorized Connections - The subscriber shall not allow unauthorized connections to Northern Host, unauthorized reselling of Northern Host, or the solicitation of Northern Host users to become subscribers to other online service providers in competition with Northern Host, nor shall the subscriber make any unauthorized copies or duplications of any Northern Host material, advertising, forms, brochures, pamphlets and the like which is the property of Northern Host.

Relationship - The relationship between the subscriber and Northern Host is that of subscriber and service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement, Northern Host reserves the right to immediately terminate the services provided to the subscriber.

Court Venue - In the event of a dispute, Northern Host and the subscriber agree that the venue for such litigation shall be Mio, Michigan and that the terms and conditions of this agreement shall be interpreted under the laws of the State of Michigan.

SPAM Policy - The transmission of any type of material, whether graphical or textual in content, to other subscribers or non-subscribers without their express consent is prohibited under the terms of this agreement. Any violations of our SPAM policy will result in immediate termination. Any complaints received from our subscribers or non-subscribers of unsolicited materials will result in a charge of $500.00 per complaint charged to the offending subscribers account automatically.

Changes to the Terms of Service - Northern Host reserves the right to revise its policies at any time without notice. Please visit our website often to stay up to date with our latest policies.

Unauthorized use of Northern Host Equipment and Services - Any subscriber attempting to attack Northern Host's equipment and/or services in any way will be billed at $1,000.00 per hour, with a minimum billable time period of 1 hour, to track the offending subscriber and repair any damage they may have caused.
